TERMS OF ENGAGEMENT WITH ALL NAESCON MEMBER CONSULTANTS (NMCs) |
NAESCON ( National Association of Executive Search
Consultants, India ) is an association of Third Party Recruiters across India.
All Naescon Members are committed to working in a Professional
and Transparent fashion with like minded Candidates. Theses Terms of Engagement
set out clearly the expectations any NMC has from the Candidates they are trying
their best to provide Better Career Opportunities to. All candidates working
with any NMC are expected and requested to read these terms carefully and then
abide by them.

You have, of your own will, having heard about the Naescon Member
Consultant (NMC) from friends or other sources or public recruitment firms
database or job portals or seeing its advertisements in the media or job portals
or at its site, sent the resume to the NMC and thereafter provided
additional information over phone or email
willingly.

Your resume
becomes
the
property
of
the
NMC
whom
you
have
submitted
to
should
they
wish
to
retain
it,
until
such
time
as
you
give
in
writing
that
you
wish
to
withdraw
from
their
Database,
giving
at
least
6
months
notice
at
the
time.

The NMC you have sent your CV to will be entitled to send
you over email job opening details, programs it is
conducting, information on
various HR or marketing or related practices or innovations or news, new
services or products it is launching themselves, partners or directors or any
other services by an outside company or agency they have decided to promote or
support externally.
Your CV will carry correct information at all times.
Besides as and when asked by the NMC you will provide truthfully all
informations required.
The NMC will take sufficient care to ensure that your
candidature is sent to good organizations keeping in mind your qualifications,
quality of employers you have worked with and your remuneration levels. In any
case, your resume will not be sent to any client or opening without getting
verbal / written approval from you.
Once your profile has been forwarded by an NMC to any of
their Clients and the name of such client has been revealed to you by the NMC
you will NOT approach that client either DIRECTLY or via ANOTHER Consultant for
a period of at least ONE year from the date of intimation by the NMC to you that
your CV is being forwarded to Client even if the Other Consultant claims to have
already got you shortlisted for an interview or the Client contacts you Direct. During this period if you learn of
any opportunity with the same Client (either Directly or via another Consultant
or even when contacted directly by the Client) suitable for you , you will NOT
submit your Candidature to them but instead you will immediately advise full
details of the same to the NMC Consultant who initially forwarded your profile
to Client for due follow up.
Once you have given approval for an opening available with
a NMC, you will appear for an interview and not refuse to do so as and when
communicated by the NMC based on information available to the NMC from the
client provided reasonable notice is given to you. Your not appearing for an
interview repeatedly without assigning any valid and reasonable reasons will
attract action from the NMC.
In short, during this period of ONE year you will not seek
/ take up employment with the Client EXCEPT via the NMC who proposed you and
with its Full Involvement and Consent.
Once you have accepted an offer, you would be required to
join the company on the Agreed Joining Date. You are also expected to work
ethically , diligently and professionally for a period of Six Months at least
unless there are exceptional circumstances not within your control which should
be advised clearly to the NMC who proposed you.
Should you deviate from any of the terms listed in #4, #5,
#6, # 7 and # 8 and # 9 above the NMC as well as NAESCON members are free to
take any/ all of the following actions:

Advise all NAESCON Members /
non-member
Recruitment Consultants and Clients of your Conduct along with your full CV
details.

Claim from you any Financial losses the NMC might have incurred as a result
of your misconduct.

Refer you " negatively " for any suitable opportunity as an unprofessional and unethical
candidate
-
Publicise your details on any Websites, E-mails, other Media and meetings.
Your sending the CV to any NMC and the NMC reverting back
to you advising you to see the Terms as displayed on this Page will be deemed as
your Acceptance to these Terms of Engagement unless you immediately mail the NMC
your Disagreement , withdraw your candidature and Cease and Desist from sending
your CV anymore to the NMC.
